Bought a CB750 with no title. Indiana

nitsua93
Bought it from an old guy who bought it from a barn of a guy who died. It's been in storage for 30 years and the title is nowhere to be found. What steps do I need to take to get a new title? I'd rather not get a "home made" motorcycle title. I've heard insurance is pretty bad on those. Thanks!

Re: Bought a CB750 with no title. Indiana

Hoosier Daddy
I've been doing research on this myself here in Indiana. I read on another forum the procedure  for our state and verified with a couple City / State Policemen in conversations.
You need a couple forms from here... http://www.in.gov/bmv/2366.htm

First, a Bill of Sale. Form# 44237 https://forms.in.gov/Download.aspx?id=5521 . I was told by the BMV 3 years ago I needed this when I titled a bike that I had a SIGNED INDIANA TITLE for... They told me a bill of Sale out-weighs a signed title (!)

Have the Police come and fill out an "Affidavit of Police Officer Inspection" Form # 39530 to verify the VIN. https://forms.in.gov/Download.aspx?id=4998

I was told this is ALL they NEED.

IF you have an Odometer Disclosure Statement # 43230 https://forms.in.gov/Download.aspx?id=5061 , they will even put the odometer reading on the tile. This will help on resale, otherwise they check the box that says milage is incorrect.

Now, I have heard depending on the mood of the Cleck at the BMV, they may require that you get the Certified letter is "Affidavit for Ownership of Vehicle" #23037 https://forms.in.gov/Download.aspx?id=4836 That's what alpha750 was refering to, Our locals are Prudes but the next closest branch in a neighboring town are very helpful and always been easier to deal with.

As far as bill of sale goes, the person it was last titled to is dead. So what should I do? Great post by the way Hoosier Daddy! Where in Indiana are you?

I'm in Kendallville, about 30 miles north of Ft Wayne. How about you?
Maybe I misread but is the guy who sold it to you alive? He should fill out the bill of sale.
The BMV will run a title check but it only goes back a few years. If it isn't in the database you are clear. If it is, then you need to do the certified letter dance. At least thats the way understand it.

I was born in Kendallville man. Lived there for like 8 years. I'm in Lafayette now. Let's say I can't get a hold of the guy who sold it to me. He's in his 80s and not in the best of health. If I had to, think I could get away with fudging it? I will try to get a bill of sale though signed by him first.

I fudge Bills of Sale all the time. I used to buy alot of stuff out of peoples fields/back yards that hadn't been titled for years. The reason they want a bill of sale is not so much to prove that the deal is legit,is for the sales tax. If they cannot find your vehicle in the KBB then the use the sold price on the bill of sale to establish the tax value. It's not about protecting the owners of the vehicles, its all about money. I have one bike titled as a Honda and another with an Assembled Vehicle title. They both cost me the same on insurance FWIW. Good luck.

pssst...need me to fill you out a bill of salelol

Shiney is right, at least from my experience here in Canada.

It's reasonably common during backyard deals for people to hand you a handwritten bill of sale with no price on it.  That way it's up to the buyer how they want to handle it.

Two things to consider though.  What taxes you want to pay, and how much you want to insure it for (sometimes they won't insure it for more than you paid).

I of course am always an upstanding citizen and write down the full amount, paying full taxes

Check to see if Indiana has a "Bonded Title" available.  I have done this, and there are a couple of options for putting up the bond.  I doubt they will search back 30 years.
