There are steps to take to improve conspicuity:  headlight modulator, florescent vests, additional running lights, to name a few.  The headlight modulator is legal in all 50 states, mandated by federal law; it is also legal in Canada.  I know many folks don't like them, but my experiences, on three different bikes, have shown them to be highly effective.  But then, I also wear a florescent vest, and I am adding additional running lights (LED's which are intensely bright -- 6 Watts won't kill my alternator).  Cheers!
